The Islamic Wills Essay This article is a very brief overview of the traditional Sunni Islamic law pertaining to the Islamic will. The aim of this article is to arouse awareness amongst Muslims particularly those living in the West regarding this important aspect of Islamic law. It should be stressed that when writing a will one should consult an Islamic scholar/legal expert to ensure that the will complies with Islamic law as well as the law of the country of residence. When a Muslim dies there are four duties which need to be performed. These are: 1.payment of funeral expenses 2.payment of his/her debts 3.execution his/her will 4.distribution of the remaining estate amongst the heirs according to Sharia The Islamic will is called al-wasiyya. a will is a transaction which comes into operation after the testator’s death. The will is executed after payment of funeral expenses and any outstanding debts. The one who makes a will (wasiyya) is called a testator (al-musi). the one on whose behalf a will is made is generally referred to as a legatee (al-musa lahu). Technically speaking the term testatee is perhaps a more accurate translation of al-musa lahu. The importance of the Islamic will The importance of the Islamic will (wasiyya) is clear from the following two hadith: It is the duty of a Muslim who has anything to bequest not to let two nights pass without writing a will about it. (Sahih al-Bukhari) A man may do good deeds for seventy years but if he acts unjustly when he leaves his last testament, the wickedness of his deed will be sealed upon him, and he will enter the Fire. If, (on the other hand), a man acts wickedly for seventy years but is just in his last will and testament, the goodness of his deed will be sealed upon him, and he will enter the Garden. (Ahmad and Ibn Majah) the will gives the testator an opportunity to help someone (e.g. a relative need such as an orphaned grandchild or a Christian widow) who is not entitled to inherit from him. The will can be used to clarify the nature of joint accounts, those living in commensality, appointment of guardian for one’s children and so on. In countries where the intestate succession law is different from Islamic law it becomes absolutely necessary to write a will. The Will (Al-wasiyya) The Islamic will includes both bequests and legacies, instructions and admonishments, and assignments of rights. no specific wording is necessary for making a will. In Islamic law the will (wasiyya) can be oral or written, and the intention of the testator must be clear that the wasiyya is to be executed after his death. any expression which signifies the intention of the testator is sufficient for the purpose of constituting a bequest. there should be two witnesses to the declaration of the wasiyya. A written wasiyya where there are no witnesses to an oral declaration is valid if it written in the known handwriting/signature of the testator according to Maliki and Hanbali fiqh. the wasiyya is executed after payment of debts and funeral expenses. the majority view is that debts to Allah (SWT) such as zakh, obligatory expiation etc. should be paid whether mentioned in the will or not. However, there is difference of opinion on this matter amongst the Muslim jurists. The Testator (Al-musi) every adult Muslim with reasoning ability has the legal capacity to make a will. An adult for this purpose is someone who has reached puberty. Evidence of puberty is menstruation in girls and night pollution (wet dreams) in boys. In the absence of evidence, puberty is presumed at the completion of the age of fifteen years. The Maliki and Hanbali fiqh also consider the will of a discerning (tamyiz) child as valid. Under English Law you must be at least 18 years of age to make a valid will (similarly in most of the United States of America) unless you are a military personnel in which case you may make a valid will at the age of 17. the testator must have the legal capacity to dispose of whatever he bequests in his will. When making a will the testator must be of sane mind, he must not be under any compulsion and he must understand the nature and effect of his testamentary act. The testator must of course own whatever he bequests. the testator has the right to revoke his will by a subsequent will, actually or by implication. In traditional Sunni Islamic law the power of the testator is limited in two ways: 1.firstly, he cannot bequest more than 1/3 of his net estate unless the other heirs consent to the bequest or there are no legal heirs at all or the only legal heir is the spouse who gets his/her legal share and the residue can be bequeathed. Narrated Sa‘d ibn Abi Waqqas (RA): I was stricken by an ailment that led me to the verge of death. The Prophet came to pay me a visit. I said, O Allahs Apostle! I have much property and no heir except my single daughter. Shall I give two-thirds of my property in charity? He said, No. I said, Half of it? He said, No. I said, One-third of it? He said, You may do so, though one-third is also too much, for it is better for you to leave your offspring wealthy than to leave them poor, asking others for help (Sahih al-Bukhari, Sahah Muslim, Muwatta, Tirmidhi, Abu Dawud and Ibn Majah.) 1.secondly, the testator cannot make a bequest in favour of a legal heir under traditional Sunni Muslim law. However, some Islamic countries do allow a bequest in favour of a legal heir providing the bequest does not exceed the bequeathable one-third. Legal heir in this context is one who is a legal heir at the time of death of the testator. Narrated Abu Hurayrah (RA): Allah’s Prophet (SAWS) said, Allah has appointed for everyone who has a right what is due to him, and no bequest must be made to an heir. (Abu Dawud). Similar hadith narrated by Abu Umamah (RA) and reported by Ibn Majah, Ahmad and others. The Legatee (Al-musa lahu) generally speaking, for a bequest to be valid, a legatee must be in existence at the time of death of the testator except in the case of a general and continuing legatee such as the poor, orphans etc. the legatee must be capable of owning the bequest. any bequest made in favour of any legal heir already entitled to a share is invalid under traditional Sunni Muslim law unless consented to by other legal heirs. an acknowledgement of debt in favour of a legal heir is valid. acceptance or rejection of a bequest by the legatee is only relevant after the death of the testator and not before. generally speaking once a legatee has accepted or rejected a bequest he cannot change his mind subsequently. if the legatee dies without accepting or rejecting the bequest, the bequest becomes part of the legatee’s estate according to the Hanafi fiqh because non-rejection is regarded as acceptance. According to the other three main Sunni madhahib, the right to accept or reject the bequest passes onto the heirs of the legatee. there is difference of opinion as to the time at which ownership of a bequest is transferred from the testator (or his heirs) to the legatee. According to the Hanafi and Shafii fiqh the transfer of ownership is at the time of death of the testator, according to the Maliki and Hanbali fiqh the transfer of ownership is at the time of accepting the bequest. all the Sunni madhahib agree that if the legatee dies before the testator, the bequest is invalid since a bequest can only be accepted after the death of the testator. if there is uncertainty as to whether or not the legatee survived the testator, such as a missing legatee, the bequest is invalid because the legatee must be alive at the time of death of the testator for the will to be valid. if the testator and legatee die together, such as in an air crash, and it is not certain who died first, the bequest is invalid according to the Hanafi, Maliki and Shafii fiqh. But according to the Hanbali fiqh, the bequest devolves upon the legatee’s heirs who may accept or reject it. Executor of the will (Al-wasi Al- mukhtar) the executor (al-wasi) of the will is the manager of the estate appointed by the testator. the executor has to carry out the wishes of the testator according to Islamic law, to watch the interests of the children and of the estate. The authority of the executor should be specified. Hanafi and Maliki fiqh state that the executor should be trustworthy and truthful; the Shafii fiqh state that the executor must be just. the Hanafi fiqh considers the appointment of a non-Muslim executor to be valid. the testator may appoint more than one executor, male or female. the testator should state if each executor can act independently of the other executor(s). if one starts acting as an executor, one will be regarded as having accepted the appointment, both in Islamic and in English law. I am completely against the proliferation of supermax prisons. Despite the fact that these people who are put in there are put with a reason I still think that this is not a final solution but instead it is a beginning of a bigger problem. The fact that these prisoners will one day be set free and come to join us is actually threatening after looking at the effects these super max prisons have on the victims.I will want to discuss the effects of these as analyzed in `A Necessary Evil? ` By Vince BeiserThese super max prisons are turning prisoners into mental cases; the set up of these prisons is very different in terms of isolation and activities. Unlike other prisons including Maximum security prisons where inmates can play basketball, work in the laundry room or in the dining room, the super max prison one can hardly take in to any activity, there aren’t any jobs, nothing educational.You are left alone and there is no human contact! One is locked in a room of 8 – by à ¢â‚¬â€œ 10 foot almost the whole time. One can not even see other prisoners or the prison guards. It is truly a cage of isolation. These places are meant for those prisoners who commit crimes while in prison and therefore can be as ‘prison in prison’When one is left in such isolation for a long period, a lot of things are likely to happen affecting especially the psychology of the victim. ‘Psychiatrists, activists and some correctional officials say the intense isolation of supermaxes is producing prisoners who are uncontrollably furious and sometimes violently deranged. Most of those Prisoners will one day be set free.In the past three years, in fact, Nearly 1,000 California SHU inmates at the end of their sentences were moved to less-restrictive prisons for just a few weeks, and then released’. As seen from Dr. Stuart study of effects of solitary confinement for a period longer than two decades, the examination was on more than one hundred super max priso ns and his conclusion was: super max can literally drive inmates crazy. The fact that there are many cases of people who never suffered psychiatric illnesses but once they went through super max prisons they developed such illness. This is enough good prove that these institutions are doing more harm than good. People going through these institutions are expected to come out worse than they were in the beginning. Dr Terry Kupers, a psychiatrist based in Oakland who has many years of experience in prison work had this to say â€Å"I've almost never seen self-mutilation among adult males anywhere else, but it's very common in SHUs.† At the landmark Madrid v. Gomez federal trial in 1995 over conditions at Pelican Bay, even the prison’s senior staff psychologist acknowledged seeing psychiatric deterioration among some SHU prisoners.There are problems faced and experienced by the prison in the super max prisons such as hypersensitivity to external stimuli, paranoia and sometimes hallucinations. Prisoners some time develop panic attacks, hostile fantasies involving revenge, torture, mutulatuion and outbursts. This at times gets to higher extents and the prisoner can even gorge out their eyes, they can bite chucks of their own flesh†¦ The speech of one prisoner featured is â€Å"Matthew Lowe’ he confesses that in his years at the super max prison he only had a chance to speak to five or six people in the whole period of three years. He says that he just sat there and thought of doing something crazy all the time.He has known that since then he has become paranoid and jumpy; ‘†So many times I've come so close to snapping since I got out,† he says. â€Å"One time in a store, someone cut in front of me in line—a 50-year-old guy, I don't think he even realized it. I had to catch myself, because my first thought was just to smash him.†An interview conducted to the other prisoners of the regular prisons support the fact that those in the supermax prisons are getting damaged psychologically was by Dr. Grassian. Almost all the inmates interviewed including one correctional officer admiited that other prisoners suffer serious mental deterioration in the SHU; they could be heard screa ming, banging on doors cutting themselves.

Many Faces of Oppression

Tsitsi Dangarembga address several issues concerning women in her novel, Nervous Conditions. Three main issues include coming-of-age, colonialism, and patriarchy. They are all encountered by the central character, Tambu as she grows up in colonial Rhodesia. While living on the homestead with her family, Tambu witness the examples of oppression prevalent in her environment. The women in her immediate family are domesticated and for the most part uneducated. When Tambu learns of her aunt Maiguru†s education and â€Å"success†, she tries to ignore the potential images of the women on the homestead by working hard to go to school. Once she is granted an education with the help of her uncle, Tambu finds out that her aunt Maiguru is oppressed too, only in a different setting. Therefore the struggles women face are similar regardless of their class,or level of education. Tambu learns early about the oppression of women in the traditional patriarchal way of life on her homestead. For example, Tambu can not continue to go to school because her family lack the funds for her to go. However, her brother Nhamo is granted the right to go and is expected to do well. Their father boasts about his son†s education and gives him certain rights and privileges. Tambu resents the fact that her brother is able to get an education and she is not. She is constantly in conflict with Nhamo because of Nhamo†s arrogance. He retorts, â€Å"Did you ever hear of a girl being taken away to school? With me it†s different. I was meant to be educated† (Dangarembga, 49). Speeches like this contributes to Tambu†s increasing drive and desire for education. Tambu, seeking to break away from her oppression through education, asks her parents for maize seeds to raise her own crop and sell them for tuition. Her own mother†s years of oppression seeped into discouraging Tambu. My mother said being black was a burden because it made you poor†¦ [and] being a woman was a burden because you had to bear children and look after them and the husband† (Dangarembga, 16). Discouragingly the parents give the seeds to her and she raises her crop. She notices that her crop is coming up missing and finds out her brother was stealing them to keep her from going to school. However through determination and a little assistance, Tambu raises the funds for school. Her father, in an act of dominance tries to take the money away from Tambu†s education but is unsuccessful. Tambu gains a small victory in her journey to reach her dream. The death of Nhamo is a turning point in Tambu†s life. Because Nhamo was the only son in the family, Tambu took his place. Tambu is granted the chance to be a part of colonized life and the advantages it has over the poverty she has lived. All the whileTambu goes through her schooling she sets her sights to becoming what her aunt Maiguru seems to be. â€Å"She was altogether a different kind of woman from my mother. I decided it was better to be like Maiguru, who was not poor and had not been crushed by the weight f womanhood† (Dangarembga, 16). One of the examples Tambu is shocked to know is the oppression Maiguru encounters by obtaining her Masters Degree. Tambu is accustomed to the hierarchical forms of address which place women and children lower than men. She is surprised to know a woman can go that far and wonders why no one acknowledged her aunt†s degree. Again another example of oppression in Tambu†s family, especially the women, is that they didn†t like Maiguru acquiring that amount of education and therefore did not acknowledge her level of education. They did however,celebrate Babamukuru†s Master Degree constantly and gave all praises to him, even the women joined in. Another example of the oppression in a middle class household is Maiguru†s salary. Even though she had the education and the career in teaching, Maiguru never saw a penny of her earnings. They went directly to her husband. Even Maiguru shows her acceptance to this oppression by saying, â€Å"†¦ no one even thinks about the things I gave up. But that†s how it goes†¦ and when you have a good man and lovely children, it makes it all worth while† (Dangarembga, 102). Even though Maiguru was educated, she was still expected to marry and raise children, so her education only provided another way of serving her family. This confession disappoints Tambu because it shatters her image of Maiguru being an independent role model. Now, with the influence of her cousin Nyasha,Tambu must find and become her own image of an independent, educated woman. The patriarchal way of life in Rhodesia had many levels of oppression. From the poverty-stricken homesteads to the colonialized middle-class setting, women were being oppressed from something. Author Tsitsi Dangarembga, cleverly reveals these levels of oppression in Nervous Conditions. Main character Tambu is able to see some of these levels with her opportunity to go from her homestead to her uncle†s home while she grows and goes through school. She think she has escaped the oppression when her brother dies and she has the opportunity to leave home where oppression is prevalent. Tambu fails to see that oppression exist even in a colonized setting until she learns from her aunt and idol, Maiguru. Even with a high level of education and ability to make money, there was still the opportunity for oppression to exist, in Maiguru†s example, by not acknowledging educated women or having their earnings controlled by men. Although this realization now occurs to Tambu, she tries to find some other way to resist the oppression (refusing to go to her parents† wedding). Nervous Conditions is a great example of how women struggle regardless of class or level of education and whether they accept the oppression or resist it.

The interest shown at the national and international levels concerning the fast food is derived from the scarcity of time in a competitive and dynamic. According to Atkins and Bowler (2001), emphasis is increasingly being placed on quick meal solutions due to the busier consumer lifestyle and dual-working families with children. Consumers lead increasingly busy lives, meaning that the time available to cook meals is being squeezed between work and leisure commitments. Cooking for many has ceased to be a leisure activity and instead is a chore. Consequently, this has placed more emphasis on fast food items. Fast-food is a rapidly growing industry in the world as well as in Malaysia, especially in the urban areas. Moreover, the food diversity in Malaysia is an implicit characteristic of the diversified culture of the country amongst the different regions within the states. Traditionally, Malaysians like to have home-cooked meals. However, going along with the times and due to the increasing awareness and influence of the western culture, there is a great shift in food consumption patterns among urban Malaysian families. Hence, studying this issue in the Malaysian context will provide deeper insights to the fast food industries, and consumer and government policy makers. The fast-food industry is perceived to be an American creation, but the â€Å"fish-n-chips† format has prevailed in the UK since the eighteenth century as an outlet where the working class could easily purchase inexpensive prepared food. In Malaysia, the American franchises have been dominating the fast-food and restaurant industry. It includes Kentucky Fried Chicken (KFC), McDonalds, A W, Burger King, Subway, Starbucks, Dunkin Donuts, Pizza Hut, Domino Pizza, Kenny Rogers Roasters, Haagen Dazs, Swensons, Famous Amos, Auntie Anne’s and the Outback Steak House. Among the 6000 (approximately) franchise outlets in Malaysia, foods and beverages dominate the franchising sector (fast-food retail was about 32%), whereas, the local fast-food or Quick Service Restaurant (QSR) market was valued at $493 million (RM 1.8 billion). : At present, the largest foreign franchise operator in Malaysia is KFC. It has entered the Malaysian market in 1973, and since then KFC dominates the market with 447 outlets and 46% market share in the fast-food or QSR market. Essentially, KFC and Pizza Hut in Malaysia are owned by the same group of companies, QSR Brands Bhd which in total, controls 60% of the QSR in Malaysia. The top performers in fast-food retailing stores are KFC (46%), followed by McDonaldà ¢s (25%), and Pizza Hut (14%) (Malaysian Franchise Association, 2006). Though Malaysia is a multi racial and multi religious country, a large number of population in Malaysia are Muslims. Therefore, chicken is very popular here as it is free from religious restrictions. Since there is no significant presence of other foreign fast-food franchises in Malaysia, the American franchises are mainly competing among themselves and with several successful local fast-food retailers. The most successful local fast-food brand is â€Å"Ayamas† (Fast Food Consumption Trend in Malaysia, 2008). Problem Statement  There has been a sustained increase in the demand for convenience foods and snacks over a number of years (Traill, 1994; Keynote, 2003). The global expansion of fast food markets prepared the way for a rise in the number and power of multi-national fast-food corporations (Schlosser, 2001). Initially, due to the cultural mismatch the multinational fast-food outlets faced the challenges of getting acceptance by the Malaysian consumers. Today, the fast-food industry is being adapted to Malaysian food requirements and is a growing phenomenon in Malaysia. However, as per the author’s knowledge, little researches have been done in this field, especially in developing countries like Malaysia. Moreover, factors affecting consumer’s choice to purchase fast food can vary in a great way in Asian countries than West. Taken this opportunity into account, the current study has tried to fill this gap by exploring this issue using the country specific measures. As fast-food consumption has gained the acceptance primarily in Malaysian consumers, Malaysian consumers have been considered as the subject of the study. The problem statement for this study is therefore to understand the factors that influence fast food consumption in Malaysia. To analyze the factors that influence fast food consumption in Malaysia.  Research Questions  Are Malaysian people aware of fast food?  Fast food, it’s another word for an unhealthy meal. It’s convenient, quick and cheap and no preparation is needed. It’s the reason why many adults and children settle for this option of eating, but it’s also the reason why many of us are so unhealthy. There’s nothing good about eating fast food other than the taste. It’s high in sugar and salt and lacks in nutrition, it’s definitely not a meal that should be eaten every day. Not everything inside these fast foods is real; they contain high amounts of preservatives and artificial substances and at times even industrial chemicals.  Fast food chains such as McDonalds and Hungry Jack’s are the main cause of obesity in children and in adults. Obesity can lead to high blood pressure, diabetes, joint problems and heart disease. Also obesity is hereditary and may be passed on to affect younger ones, even if they eat a healthy diet. With obesity on the up rise, many teenagers are being either prevented or distracted from doing things helpful towards them. Not only does fast food degrade these children physically, but also mentally. These obese children may be targeted at school and be picked on because of their appearance, which may lead to low self esteem and depression.  After considering the above points, it clearly shows that fast food consumption has a negative impact on society. It interferes with our lives and at the same time is a hazard to our health. This affects us and our future generation.  The study has focused on the relations between attribute perceptions, overall customer satisfaction and store sales performance. To capture the relationship between attribute perceptions and overall customer satisfaction, we have identified how customers interpret and respond to the products and services they buy and experience. Here it is essential to distinguish between specific attributes of a product or a service and the satisfaction factor they represent. In food retailing, for instance, consumers may put high value on a factor that might be called customer service provided by the supermarket. This is an example of an abstract or subjective benefit. This abstract benefit depends on a set of related measurable at- tributes such as the disposition of the cashiers and sales associates, speed and accuracy of checkout, and availability of everyday grocery items and store cleanliness, among others. In addition to customer service, other relevant factors affecting overall customer satisfaction in grocery stores include the store ambiance, the perceived product quality of (growing) perishables departmentsnow 50 percent or more of store sales in some storessuch as fresh pro- duce, daily/bakery, seafood, fresh meat and floral, as well as the perceived value of products relative to their price. The fast food restaurants are now in the growing pace as it is convenience and suits the lifestyle of Malaysians citizens who are now having a more hectic and busy lifestyle. Fast food outlets in Malaysia provide a wide range of products and also delivery services that suits the preferences of various consumers.
